Does my auto insurance from the United States cover me in Mexico?
Your U.S. car insurance policy has several different types of coverage. The liability coverage of your U.S. car insurance policy will have no legal bearing in Mexico. This means if you were involved in an accident in which you injured another driver or damaged another vehicle, you would not be covered, and you could possibly be arrested if you didn’t have Mexican car insurance.
In addition, auto accidents in Mexico are subject to the laws of Mexico, not the laws of the United States. Under Mexican Law auto accidents are considered a criminal offense as well as a Civil Matter.
Is auto insurance required in Mexico?
Auto liability insurance is not required in all parts of Mexico, neither for Mexican drivers nor for foreign drivers. Mexico instead requires “proof of financial responsibility” to cover an auto accident, which includes but does not mandate insurance. So even if you are not at fault in an accident in Mexico you could end up without any coverage unless you have purchased your own Mexico policy. If you are at fault in an accident, you will likely be detained by the police until they have determined if you can make payments to the other party. A Mexican auto insurance policy can include coverage for legal assistance in Mexico.
